ORDER
The transfer application is filed seeking transfer of petition for divorce 1/5
filed by respondent/wife pending on the file of Principal Sub-Court, Madurai.
2. The petitioner herein seeks transfer of petition for divorce in H.M.O.P.No.198 of 2025 filed by the respondent/wife mainly on the ground that both the petitioner and the respondent lived together within the jurisdiction of Sub-Court, Poonamallee. It is also stated that he is residing at Thiruverkadu near Poonamallee. He has difficulty in traveling to Madurai to contest the divorce petition filed by the respondent. It is pertinent to mention that the petitioner herein filed a petition for restitution of conjugal rights in HMOP No.352 of 2024 on the file of Sub-Court, Poonamallee and the said OP was transferred to Principal Sub-Court Madurai at the instance of respondent/ wife as per the order passed by Madurai bench of this Court in Transfer CMP.(MD).No.53 of 2025. When the petitioner is able to travel to Madurai to conduct his case in HMOP.No.352 of 2024, the reason given by him in the instant transfer application for transferring divorce petition filed by his wife to Poonamallee is not acceptable to this court. Therefore, the transfer CMP is 2/5
dismissed. However, the Principal Sub-Court, Madurai is directed to tag the HMOP.No.198 of 2025, the divorce petition filed by the respondent/wife along with the petition for restitution of conjugal rights filed by the petitioner/husband, which was transferred to Madurai and renumbered as HMOP.No.124 of 2025 and conduct the joint trial.
3. Both the petitions shall be disposed of by the Principal Sub-Court, Madurai as expediently as possible.
4. Accordingly, the Transfer Civil Miscellaneous Petition stands dismissed. Consequently, the connected miscellaneous petition is closed. No costs.
