O R D E R

This criminal original petition has been filed to call for the records in FIR.No.666 of 2024, registered for the offences under Section 126 (2) and 189 (2) of the BNS, 2023 on the file of the 1st respondent police and quash the same.

2. The learned counsel for the petitioner would submit that the petitioner is a serving member of the Legislative Assembly from Veppannapalli Constituency, Krishnagiri District and holding the post of Deputy General Secretary in All India Anna Dravida Munnetra Kazhagam (AIADMK) and also a former Minister. He would further submit that a protest was conducted against the failure of the Government to prevent sexual violence and harassment against women in Chennai and other districts. However, a false complaint has been 2/6

given against the petitioner and the entire proceeding is an abuse of process of law.

3. The learned Additional Public Prosecutor vehemently opposed the petition stating that the Government had taken all possible steps to protect women and children in the State, whereas the petitioner has unnecessarily conducted the protest.

4. Heard the learned counsel on either side and perused the records.

The facts of the instant case are similar to the facts of the cases in Jeevanandham and others vs. The Inspector of Police, Velayuthampalayam Police Station, Karur District reported in (2018 2 LW (Crl) 606) and Sri Raja vs Inspector of Police, Sivakasi Town Police Station Virudhunagar District and others (Crl.O.P(MD) No.7922 of 2019, decided on 30.08.2019), in which the proceedings were quashed.

6. In view of the above, this Court is of the opinion that the above said decisions would apply on all fours to the present case and that no useful 3/6

purpose will be served by keeping the proceedings pending.

7. Accordingly, this criminal original petition stands allowed and the First Information Report in Crime No.666 of 2024, on the file of the 1st respondent police is hereby quashed. Consequently, the connected miscellaneous petition is closed.
