ORDER

This petition has been filed to direct the 1st respondent to transfer the investigation in Crime No.171/2025 from the file of the 2nd respondent to any other Investigating Agency in accordance with law.

2. When the matter was taken up for hearing, the learned Government Advocate (Crl. Side) submitted that the petitioner's wife one XXX has gone away with the third respondent. Based on a complaint given by the petitioner, case in Crime No.171 of 2025 has been filed for woman-missing. Preliminary investigation reveals that the petitioner's wife has gone along with the third respondent only on her own volition and they are hiding somewhere. He further submitted that it is not the first occasion and even on an earlier occasion also, the petitioner's wife had gone along with the third respondent and a case was also registered in Crime No.465 of 2023. He further submitted that investigation in this case is being done to find out the whereabouts of the petitioner's wife.

3. In view of the above submission of the learned Government Advocate (Crl. Side), this Court finds that there is no requirement for transfer of investigation. Accordingly, the Criminal Original Petition stands closed. 18-11-2025 vum Index:Yes/No Speaking/Non-speaking order
