O R D E R

The present Criminal Original Petition has been filed seeking to quash the First Information Report registered against the petitioner on the 1/4

file of the respondent Police in Crime No.275 of 2025 for the offences under Sections 303(2) and 326(a) of the BNS and Section 21(1) of the Mines and Minerals (Development & Regulation) Act, 1957. 2.

Learned counsel appearing for the petitioner submitted that the petitioner had obtained permission from the Tahsildhar, Gummidipoondi for mining savudu sand. However, the respondent Police, without verifying the same, registered a case against the petitioner on 15.10.2025. Therefore, he prayed for quashing the First Information Report pending against the petitioner.

Learned Government Advocate (Criminal Side) appearing for the respondent Police, on instructions, submitted that it is true that the petitioner was granted permission by the Tahsildhar, Gummidipoondi, to take savudu sand from Otteri lake for his personal use. However, the petitioner, in violation of the order passed by the Tahsildhar, Gummidipoondi, had taken sand from the Sinthalakuppam Lake. Therefore, the present case has been registered against him. He also submitted that the case was registered only on 15.10.2025 and the investigation is at the initial stage.

Having heard the learned counsel appearing on either side and upon perusal of the entire materials available on record and taking note of the fact that the investigation is at a nascent stage, this Court is not inclined to interfere with the investigation at this stage. 5.

Accordingly, this Criminal Original Petition stands closed. Consequently, the connected miscellaneous petition is closed. 25.11.2025 ham To 1.
