(Order of the Court was made by Dr. ANITA SUMANTH., J.) This is a petition seeking condonation of delay of 39 days in filing the Writ Appeal.

2. Notice has been served upon the respondent and its description printed in the cause list. However, none appears.

3. The reason for condonation is set out at paragraph 3 of the affidavit filed in support of the petition to state that the delay was occasioned as the impugned order has been forwarded to the learned Special Government Pleader and awaiting his legal opinion.

4. Having regard to the fact that the delay is only 39 days and the reasons set out seeking condonation, the delay of 39 days in filing the Writ Appeal is condoned and this Miscellaneous Petition is ordered.

5. Registry is directed to number the Writ Appeal, if it is otherwise in order and list the same for admission.
