Respondent(s) PRAYER;This writ petition is filed under Article 226 of Constitution of India, to issue a Writ of Mandamus, directing the respondents to consider the representation of the petitioner dated 21.10.2020 to grant a pension and other monetary benefits for the elected tenure 2009- 2011 as a Member of legislative Assembly of the Ilayangudi Constituency.

ORDER

This petition has been filed seeking a direction to the respondents to consider the representation of the petitioner dated 21.10.2020 to grant a pension and other monetary benefits for the elected tenure 2009- 2011 as a Member of Legislative Assembly of the Ilayangudi Constituency.

2. It is the case of the petitioner that the petitioner was elected as the member of Legislative Assembly for Ilayangudi Assembly Constituency, for the period of two years. However, the respondents have not disbursed pension and other attendant benefits for his tenure from 2009 to 2011. Hence, the petition has made representation on 21.10.2020 to grant a pension and other monetary benefits for his tenure and the same is not considered. The petitioner election election was challenged before this Court and the same was allowed, against which, the petitioner approached before the Hon'ble Apex Court and the same was allowed by uphelding the election of the petitioner. Hence, the present writ petition is filed for MLA Pension and all monetary benefits for the year 20062011.

3. The learned counsel for the petitioner submitted that this Court may direct the respondents to consider and pass orders on the petitioners representation within the stipulated time as fixed by this Court.

4. The learned Special Government Pleader appearing for the respondents submitted that the representation will be considered and orders will be passed within the stipulated time as fixed by this Court.

5. Heard the learned counsel for both side and perused the materials available on record.

6. Considering the facts and circumstances of the case and in view of the limited request sought for by the petitioner, this court directs the second respondent to consider and pass orders on the petitioner's representation dated 21.10.2020 within a period of six weeks from the date of receipt of a copy of this order.
