ORDER
This Criminal Miscellaneous Petition has been filed to modify one of the conditions imposed by this Court in Crl.OP.No.27308 of 2025 dated 03.10.2025.
2. The learned counsel for the petitioner submitted that while granting bail, this Court passed one of the conditions imposed on the petitioner in Paragraph No.7(b) which reads as follows:
'' the petitioner is directed to deposit a sum of Rs.50,000/- (Rupees Fifty Thousand only) as non-refundable deposit either through RTGS/NEFT/Cash/Demand Draft in favour of the Dean, Rajiv Gandhi Government General Hospital, Chennai bearing A/c.No.10273425961, State Bank of India, Park Town (Chennai), 68,
Evenening Bazaar Road, Chennai, IFSC Code: SBIN0001856' imposed in Crl.OP.No.27308 of 2025 dated 03.10.2025'' He further submitted that since the petitioner was not able to deposit Rs,50,000/- as ordered by this Court, he is still in custody. He also submitted that already 90 days were completed. So far final report is not yet filed. Hence, the modification petition has been filed by the petitioner.
3. The learned Government Advocate (Criminal Side) appearing for the respondent police strongly opposed to modify the condition, since the petitioner was not able to deposit Rs,50,000/- as ordered by this Court.
4. Being satisfied with the reasons stated by the petitioner, this Court is inclined to modify the condition that '' the petitioner shall not deposit a sum of Rs.50,000/- (Rupees Fifty Thousand only)'' and accordingly the same is cancelled. The other conditions imposed by the Court shall remain intact.
5. With the above modification, this Criminal Miscellaneous Petition is ordered.
