Prayer:- Writ petition filed under Article 226 of the Constitution of India praying for issuance of a writ of Mandamus directing the 1st and 2nd respondents to review the continuance of suspension of the petitioner from 07.07.2024 as prescribed under G.O(Ms) No.30, P and AR Department dated 23.02.2012, within a reasonable periods may be fixed by this Honourable Court so as to permit her to rejoin duty in any department of the Dindigul City Municipal Corporation.

This Writ Petition has been filed for a direction directing the respondents 1 and 2 to review of the order of suspension dated 07.07.2024.

2. Heard the learned counsel appearing on either side and perused the materials available on record.

3. The petitioner was initially appointed as a Junior Assistant on a compassionate ground and subsequently promoted to the post of Superintendent. While being so, she was suspended from service on 07.07.2024 on the ground that she failed to supervise the malpractices done by one Thriru M.Saravana, Two charge memos under Rule 17(b) of the Tamil Nadu Civil Services (Discipline and Appeal) Rules, 1955, were also issued to the petitioner. A criminal case is also pending against the petitioner.

A perusal of the charge memos revealed that the charges are very serious in nature as the petitioner and others have allegedly misappropriated funds of the Dingigul City Municipal Corporation to the tune of Rs.4,67,17,988/- and caused a huge loss to the exchequer. Further, the investigation in the criminal case is still pending. Therefore, a prima facie case has been made out by the respondents to suspend the petitioner from service.

5. In view of the above, this Court is not inclined to issue any direction to the respondents to consider the petitioner's representation seeking revocation of her suspension. However, the 3rd respondent is directed to conclude the disciplinary proceedings against the petitioner within a period of six months from the date of receipt of a copy of this order.
