O R D E R

(Order of the Court was made by R.SURESH KUMAR, J.) The delay is 624 days. The reasons cited by the petitioners for such delay reads thus:

"I state that even though the order impugned in the present Writ Appeal was pronounced on 19.01.2024, the copy of the Judgement was obtained on 21.06.2024 only. Thereafter the person in charge of the seat got transferred and there occasioned delay in anlaysing legal implication for implementation of the Hon'ble High Court of Madras 2/5

Judgement dated 19.01.2024 with reference to the Judgement of the Hon'ble Supreme Court of India case in .C.P.(C) Diary No.6415/2021 in SLP © No.2286/2016 dated 18.04.2023 and 18.07.2023 and subsequent instructions from the Government in letter No.5230612/S.Spl.2023-11, dated 14.09.2023. The above said reasons caused the delay in filing the present Writ Appeal, which is neither willful nor wanton."

Having heard the learned Additional Government Pleader appearing for the petitioners and the learned counsel appearing for the respondents 1 & 2 and after having found that certainly some prejudice would have been caused to the respondents 1 & 2 if the delay is condoned, we deem it appropriate to allow this petition only on terms, therefore, the petitioners shall pay a sum of Rs.10,000/- (Rupees Ten Thousand only) to the respondents 1 & 2 through the learned counsel for the respondents, within a period of two weeks from the date of receipt of a copy of this order. On such condition, this Civil Miscellaneous Petition is ordered.
