Writ Petition is filed under Article 226 of Constitution of India praying to issue a Writ of Certiorarified Mandamus calling for the records in relation to impugned order dated 16.09.2025 bearing Na.Ka. No.A7/2334/2024 passed by the 1st Respondent in proceedings under Maintenance and Welfare of parents and Senior Citizens Act, 2007 and quash the same as illegal, arbitrary and consequentially direct the 1st Respondent to decide complaint of the petitioner on the merits. O R D E R

This writ petition has been filed challenging the order dated 16.09.2025 bearing Na.Ka. No.A7/2334/2024 passed by the 1st Respondent in proceedings under Maintenance and Welfare of parents and Senior Citizens Act, 2007 2.

The learned counsel for the petitioner seeks permission of this Court to withdraw this writ petition and also she seeks liberty to file appeal against the impugned order before the appellate authority. Further, on obtaining permission from this Court, she made endorsement to that effect in the case bundle.

3. Therefore, this writ petition is dismissed as withdrawn with liberty to file an appeal against the impugned order before the appellate authority within a period of two week from the date of receipt of this order. On receipt of the said appeal, the appellate authority is directed to conduct enquiry after issuance of notice to the petitioner and counter parties, if any, and to dispose of the said appeal within a period of twelve 2/4

weeks from the date of receipt of the appeal. There shall be no order as to costs.
