ORDER
The World is full of Good People and so it rains and so we thrive. Here are the parents who, in spite of their economic adversity, that is, the father being physically challenged and living expecting help from the Governmental Assistance and the mother, a housewife eking out a livelihood by tailoring, thought it fit to give the best of the education possible to their children. Accordingly, they put their wards, H.Kameswaran and H.Vigneshwaran, who completed the 12th standard and 10th Standard respectively, in the 3rd respondent School, namely Kannada Sangha Higher Secondary School, Ayanavaram, Chennai-600 023.
2. It is seen that they were unable to pay the school fees in respect of both the students, amounting Rs.54,200/- for the elder and Rs.23,700/- for the younger son. Notwithstanding the non-payment of fees, the School, on its part did its best not to disturb the students and the students wrote their examinations. It was only when the petitioner-mother wanted to get the Transfer Certificate, they insisted on the payment of the balance outstanding.
3. When something had to be done legally, Mr.Purushothaman, Learned Counsel practising in this Court, took up the issue pro bono.
4. When the matter came up for hearing and when the Court suggested to resolve the issue by the contribution of the members of the Bar, the Bar Association and some of its eminent members readily accepted and it is stated that these four members, namely Mr.Venkataramani, Learned Senior Advocate (who was also present before the Court and when the suggestion was made and immediately accepted it), Mr.A.Jinasenan Advocate, Mr.M.Suresh Kumar, Additional Advocate General and Mr.AR.L.Sundaresan, Learned Additional Solicitor General of India have contributed and already the amount has been paid to the credit of the account of the School. Though these Learned members would not be comfortable that their names being mentioned, the same is mentioned only to qualify the first sentence by which this judgment began: the World is full of Good People.
5. The Headmaster of the School is present. He states that he will verify the account and today itself and the Transfer Certificates will be handed over to the respective students.
6. In view thereof, the issue is resolved and it is hoped that the children will continue their education in the best possible way. The Court also places its
appreciation to the Madras Bar Association and its Office bearers for taking up the issue with their members and doing the needful by collecting the money and depositing it into the school account as well as the efforts put in by Mr.P.Dinesh Kumar, Learned Advocate, who assisted in this regard.
7. Accordingly, the Writ Petition is disposed of. There shall be no order as to costs.
