ORDER
This criminal original petition has been filed by the petitioner to modify the condition imposed on him in para No.5(c) of the order passed by the Hon'ble Principal Sessions Judge, Ranipet in Crl.M.P.No.1522 of 2025 dated 29.10.2025 that, "the petitioner shall deposit a sum of Rs.7,00,000/- (Rupees Seven Lakhs only) before the learned Judicial Magistrate No.I, Arakkonam shall accept the sureties furnished by the petitioner". 2.
The learned counsel appearing for the petitioner submitted that the petitioner is a college student and he has been falsely implicated in this case; that on the alleged date of occurrence, the petitioner was present in his college and he has not committed any offence; that the petitioner is in judicial custody since 05.10.2025. He further submitted that the petitioner filed a bail petition before the Principal Sessions Judge, Ranipet in Crl.M.P.No.1522 of 2025 and the same was allowed by an order dated 29.10.2025 by imposing one of the conditions that the petitioner shall deposit a sum of Rs.7,00,000/- before the learned Judicial Magistrate No.I, Arakkonam at the time of executing the sureties; that inspite of being granted bail, the petitioner is still in judicial custody, on account of the said condition, hence prays to modify the said condition.

The learned Government Advocate (Crl. Side) appearing for the respondent submitted that the petitioner joined hands with other accused cheated the defacto complainant to the tune of Rs.7,17,000/- by misusing the ATM card of the defacto complainant; that no amount has been recovered till date; that the petitioner has no previous antecedents; and that the investigation of this case is pending, hence opposed this modification petition. 4.
Considering the submissions made on both sides, nature of offence, this Court is of the view that the condition of deposit as imposed on the petitioner herein by the learned Principal Sessions Judge, Ranipet in Crl.M.P.No.1522 of 2025 dated 29.10.2025 is reasonable. However considering the fact that the petitioner is a college student, he has no previous antecedents and he is still in custody inspite of granted bail by the lower Court, I am of the view that the condition to deposit a sum of Rs.7,00,000/- as imposed on the petitioner herein by the learned Principal Sessions Judge, Ranipet in Crl.M.P.No.1522 of 2025 dated 29.10.2025 alone is modified to the effect that the petitioner shall deposit a sum of Rs.5,00,000/- (Rupees Five Lakhs only) before the learned Judicial Magistrate No.I, Arakkonam at the time of executing the sureties and the other conditions remain intact. 3/4
