ORDER

This Criminal Original Petition has been filed to modify the condition imposed by the learned Principal Sessions Judge, Chennai, in Crl.M.P.No.10535 of 2025 dated 05.11.2025.

2. The learned counsel for the petitioner submitted that the petitioner is not an accused and the lower Court, while granting bail to the petitioner, imposed a condition that the petitioner shall deposit a sum of Rs.3,00,000/- (Rupees Three Lakhs Only) before the learned Metropolitan Magistrate for the exclusive trial of CCB Cases (relating to Cheating Cases in Chennai) and CBCID Metro Cases, Chennai, in Crime No.148/2025. He further submitted that the petitioner/accused is working as an house maid and she is a senior citizen hailing from economically weaker section and in below poverty line, and she could not come out on bail even after she was granted bail, because of the condition imposed upon this petitioner. Hence, the modification petition has been filed by the petitioner.

3.I have also gone through the bail orders passed by the learned Sessions Judge and it revealed that this petitioner colluding with other accused,

impersonated herself as if, she is the original owner of the subject property and the same is sold to the value of Rs.3 Crores. Hence, the petitioner was directed by the trial Court to pay Rs.3 lakhs as her share in the commission of offences, Therefore, I am of the view that this condition is not the onerous condition. Since the petitioner is also benefited from the fraudulent transactions involved in cheating to the tune of properties worth about Rs.3 Crores, I am not inclined to modify the condition.
