ORDER

This Writ Petition has been filed seeking for a direction to the 1st Page No.1 of 5

respondent to conduct further enquiry pursuant to the earlier Enquiry Notice dated 15.03.2025 by issuing fresh notice to the respective parties and pass final orders on the petitioner's application seeking for issuance of patta in his name for the property morefully described in the affidavit filed in support of this writ petition, within a time frame to be fixed by this Court.

2. The petitioner's grievance is that, on 15.03.2025, when the enquiry was fixed, the petitioner participated in the enquiry along with the rival claimant. However, during the course of enquiry, the petitioner claims that his maternal uncle passed away and due to the said fact, the petitioner could not participate in the enquriy further. The petitioner seeks for a fresh enquiry for the said reason. He has given a representation for the said purpose on 11.08.2025. Since the said representation has not been considered, the petitioner has filed this writ petition.

3. Mr.D.Ravichander, learned Special Government Pleader, accepts notice on behalf of the respondents 1 and 2. The 3rd respondent is the rival claimant. Since no adverse orders are passsed in this writ petition as against the 3rd respondent, notice to the 3rd respondent is Page No.2 of 5

dispensed with.

No prejudice would be caused to the respondents, if further enquiry is conducted based on the petitioner's representation pursuant to the earlier Enquiry Notice dated 15.03.2025, after hearing the objections of the 3rd respondent as well as any other third parties, whom the 1st respondent deems fit to enquire.

5. For the foregoing reasons, this writ petition is disposed of by directing the 1st respondent to conduct further enquiry pursuant to the earlier Enquiry Notice dated 15.03.2025, by issuing notice to the petitioner as well as the 3rd respondent and any other third parties, whom the 1st respondent deems fit to enquire. After hearing their respective objections and after giving due consideration to the documents filed by the petitioner along with the application seeking for issuance of patta, the 1st respondent shall pass final orders on merits and in accordance with law, within a period of twelve [12] weeks from the date of receipt of a copy of this order. No costs.
