ORDER
This petition has been filed seeking a direction to the respondent to conduct enquiry and pass final orders pursuant to the enquiry notice dated 25.03.2025
2. It is the case of the petitioner that the subject lands in S.No.51/2, 51/3 and 51/4 of Nungambakkam Village originally formed part of the Sivagiri Zamin Estate, which came under the administration of the Court of Wards in
1940. The patta stood in the names of the legal heirs of the last Zamindar. Subsequently, as five of the heirs released their rights to one Varaguna Rama Pandia Chinna Thambiyar, the patta was required to be mutated to his legal heirs, for which, the petitioner made a representation on 15.10.2020 and no action has been taken. Hence, the petitioner filed a writ petition before this Court and the same was allowed on 24.07.2020 directing the second respondent to consider the representation and pass orders within 12 weeks. Thereafter, the patta was restored in the names of the five legal heirs. The second respondent passed an order dated 25.09.2020 directing mutation of the revenue records. Thereafter, a representation dated 15.10.2020 was submitted for issuance of patta. As no action was taken, the petitioner filed a writ petition in WP. No.
20103 of 2021 was filed and by order dated 21.09.2021. This Court directed to consider the representation within 12 weeks. Thereafter, the petitioner filed appeal in AS. No.275 of 2023 and the same is pending. Thereafter, an enquiry notice was issued on 25.03.2025 scheduling enquiry on 15.04.2024. The enquiry was conducted. However, no final orders have been passed till date. Hence, the present writ petition has been filed.
3. The learned counsel for the petitioner submitted that this Court may direct the respondents to conclude the proceedings dated 25.03.2025 within the stipulated time as fixed by this Court.
4. The learned Special Government Pleader appearing for the respondent submitted that the proceedings will be concluded and appropriate orders will be passed within the stipulated time as fixed by this Court.
5. Heard the learned counsel for both side and perused the materials
available on record.
6. Considering the facts and circumstances of the case and in view of the limited request sought for by the petitioner, this court directs the first respondent to conclude the proceedings and pass orders after providing opportunity to the necessary parties within a period of four weeks from the date of receipt of a copy of this order.
