Writ Petition is filed under Article 226 of the Constitution of India praying to issue a Writ of Certiorarified Mandamus, calling for the records of the enquiry proceedings of the second respondent dated 30.06.2025 in Na.Ka.No.010002/C3/E2/2025 and quash the same and consequently direct the first respondent to pay the subsistence allowance and dearness allowance admissible under the rules.

O R D E R

This writ petition has been filed challenging the order of punishment dated 30.06.2025 passed by the second respondent.

2. Heard the learned counsel for both sides and perused the materials available on record.

3.On perusal of the impugned order in this Writ Petition, it is revealed that there is an appeal provision available against the said order. However, the petitioner has not filed any appeal. When an appeal remedy is 2/5

very much available, this Court cannot entertain this Writ Petition under Article 226 of the Constitution of India unless the petitioner makes out a case on the ground of lack of jurisdiction, violation of principles of natural justice, or contravention of statutory provisions. Therefore, this Writ Petition is not maintainable.

4. In the result, this Writ Petition dismissed. However, the petitioner is at liberty to prefer an appeal before the Appellate Authority within a period of two weeks from today. On receipt of such appeal, the Appellate Authority is directed to consider the same, after issuing notice to the petitioner and affording him an opportunity of personal hearing, and to pass orders on merits and in accordance with law, within a period of twelve weeks from the date of receipt of a copy of this order.
