PRAYER : Writ Petition filed under Article 226 of the Constitution of India praying for issuance of a Writ of Mandamus, directing the respondents 2nd to 5th to fix the pay of the petitioner and to sanction his terminal benefits of Rs.20,22,304/- (Rupees Twenty Lakhs Twenty Two Thousand Three Hundred and four only) by considering the petitioner's notice dated 23.06.2025 within a time frame as may be fixed by this Court. This Writ Petition has been filed seeking a direction to the respondents 2nd to 5th to fix the pay of the petitioner and to sanction his terminal benefits of Rs.20,22,304/- (Rupees Twenty Lakhs Twenty Two Thousand Three Hundred and four only) by considering the petitioner's notice dated 23.06.2025
2. It is the case of the petitioners that the petitioner joined the services of the 5th respondent in the year 1987 as Salesman and got promotions and retired in the year 2002 as the Secretary of the 5th respondent. He was
permitted to retire on attaining the age of superannuation. The respondents have issued necessary instructions to implement the new pay scales to all the employees of the societies in Tamil Nadu. Accordingly, Circular dated 09.02.2016 has been issued by the second respondent. However, the petitioner was not fixed in the new pay scale and other persons who were working in the same society, have been granted the benefit. Therefore, petitioner made a representation to the respondents and the same was not considered. Hence, the petitioner has filed a writ petition before this Court in WP.No.17719 of 2023 directing the respondents to fix the pay of the petitioner in the new scales. This Court vide order dated 19.12.2022, directing the third respondent to consider the representation of the petitioner.
Pursuant to which, the third respondent on 02.04.2025 issued a proceedings to the petitioner by furnishing the details about the medical leave and the non submission of medical certificate. The fixation of pay and other pension benefits have not been mentioned therein. Hence, the petitioner sent a notice to the respondents 3 & 4 on 23.06.2025 furnished the list of payments due and payable to the petitioner and requested to pay the sum of Rs.19,06,500/- to the petitioner. The matter is still pending. Hence, the present writ petition.
3. The learned counsel for the petitioner submitted that this Court may issue a direction to the petitioner's notice and pass appropriate orders within the stipulated time as fixed by this Court.
4. The learned Special Government Pleader appearing for the respondents submitted that the reply will be sent to the petitioner as expeditiously as possible.
5. Heard the learned counsels appearing on either side and perused the materials available on record.
6. Considering the facts and circumstances of the case and in view of the limited request sought for by the petitioner, this Court directs the 5th respondent to consider and pass orders on the petitioner's notice dated 23.06.2025 within a period of twelve weeks from the date of receipt of a copy of this order.
7. With the above direction, the writ petition stands disposed of. No costs.

2.The learned counsel appearing for the petitioner submitted that the petitioner retired in the year 2022, however, in the order dated 17.12.2025 made in W.P.No.48286 of 2025, inadvertently, it has been mentioned as 2002 and prayed for appropriate orders. 3.In view of the above, in the order dated 17.12.2025 made in W.P.No.48286 of 2025, the first sentence of paragraph no.2 is to be read as follows:
"It is the case of the petitioner that the petitioner joined the services of the 5th respondent in the year 1987 as Salesman and got promotions and retired in the year 2022 as the Secretary of the 5th respondent."
