The petitioner, who was arrested and remanded to judicial custody on 14.10.2025 for the alleged offence under Section 318(4) of the BNS 2023. in Crime No.390 of 2025 on the file of the respondent police, seeks bail.

The case of prosecution is that the defacto complainant is running a gold dying unit and gold smith business and the petitioner received 6 kgs and 997 of gold from the defacto complainant for business purpose and failed to return the same. Hence, the complaint was registered against the petitioner.

3. The learned counsel appearing for petitioner submitted that the petitioner and he is no way connected with the offence. He would submit that he has not at all committed any of offence as alleged by the respondent police and he has been falsely implicated in this case and he will abide by any condition that may be imposed by this court. Hence, he prayed to grant bail to the petitioner.

4. The learned Government Advocate (Crl. Side) appearing for 2/4

respondent reiterated the prosecution case and submitted that investigation in this case is not yet completed. Hence, he would vehemently opposed to grant bail to the petitioner.

Considering the facts, quantity of gold involved in this case and the investigation is pending and as on date recovery are to be made, this Court is not inclined to grant bail to the petitioner. 6.
