ORDER
This writ petition has been filed to direct the 2nd respondent to consider the petitioner representation dated 17.12.2024.
2. Mr.U.Baranidharan, learned Special Government Pleader, takes notice on behalf of the respondents 1 & 2.
3. By consent of the parties, the main writ petition has been taken up for disposal at the stage of admission itself.
4. The learned counsel for the petitioner would submit that in this case, the petitioner and the 3rd respondent had entered into a sale agreement dated 04.09.2024 in respect of the subject property for a sale consideration of Rs.1,32,99,750/-. Out of the said amount, the petitioner paid a sum of Rs.10,00,000/- as advance amount. However, it came to the knowledge of the petitioner that now, the 3rd respondent is making attempt to sell the very same subject property to some other 3rd party and also the 3rd respondent is refusing to repay the advance amount paid by 2/6
the petitioner. Under these circumstances, the petitioner filed a representation in the form of protest petition before the 2nd respondent. However, the said representation was not at all considered by the 2nd respondent till date. Hence, this petition.

In reply, the learned Government Advocate appearing for the respondents would submit that the petitioner's representation/protest petition will be considered, if any deeds or documents, in respect of the subject property, was presented before the official respondents for the purpose of registration.
6. Heard the learned counsel for the petitioner and the learned Special Government Pleader appearing for the respondents and also perused the entire materials available on record.
7. In the case on hand, the petitioner and the 3rd respondent had entered into a sale agreement dated 04.09.2024 in respect of the subject property for a sale consideration of Rs.1,32,99,750/-, out of which, the 3/6

Having received the said amount, now, the 3rd respondent is making attempt to sell the very same subject property to some other 3rd party and also the 3rd respondent is refusing to repay the advance amount paid by the petitioner. Therefore, the petitioner filed a representation in the form of protest petition before the 2nd respondent. However, the said representation was not at all considered by the 2nd respondent till date.
8. In view of the above, this Court directs the 2nd respondent to consider the petitioner's representation petition dated 17.12.2024, in the event, if any deed or document, in respect of the subject property, was presented before the official respondents for the purpose of registration.
9. With the above directions, this writ petition is disposed of. No cost.
