This petition has been filed seeking condonation of delay of 202 days in preferring the First Appeal.

2.Heard the learned counsel for the petitioner and perused the materials available on record.

3.Despite service of notice, the respondents have neither chosen to appear in person nor through counsel.

4.The petitioner is a third party, who claims to be the caretaker and a resident of Auroville, which is the subject matter of the dispute in the suit. According to the petitioner, he is residing in the schedule property and taking care of the agricultural operations therein. It is his further case that his valuable rights have been taken away under the decree passed behind his back and that he came to know of the decree only on 04.06.2025, when the plaintiff sent an e-mail to the resident stating that 1/3

they do not intend to prefer any appeal as against the judgment and decree passed by the Trial Court. According to the petitioner, the decree necessarily requires to be challenged and, thereafter, he has taken steps to prefer the First Appeal.

5.Considering the reasons assigned by the petitioner in the affidavit filed in support of the petition and being satisfied with the same, this Court is inclined to allow this petition. Accordingly, this petition is ordered as prayed for.
