This Civil Miscellaneous petition has been filed seeking to grant leave to prefer an appeal against the judgment dated 22.01.2025 in O.S.No.3 of 2021 on the file of the I Additional District Court, Tindivanam.

2. Heard the learned counsel for the petitioner.

3. The learned counsel for the petitioner submits that the petitioner has been taking care of the suit properties on behalf of the plaintiff/Auroville Foundation. However, the suit came to be dismissed and the grievance of the petitioner is that no appeal has been preferred by the plaintiff as against the judgment and decree passed by the Trial Court. The petitioner asserts that he is in possession under the plaintiff/Auroville Foundation and that, if the judgment and decree of the Trial Court is not appealed against, the same would cause serious prejudice to the petitioner. It is further contention of the petitioner that he intends to protect the rights and interests of the plaintiff/ Auroville Foundation only.

4. In the light of the above submissions, I am inclined to grant leave to the petitioner to prefer the appeal. Accordingly, leave is granted as prayed for.
