ORDER

This criminal original petition has been filed by the petitioner/accused seeking speedy disposal of the trial in Special Sessions Case No.56 of 2024, pending on the file of the Special Court for Exclusive Trial of Cases under the POCSO Act at Chennai. 2.The learned counsel for the petitioner would submit that the wife of the petitioner, on account of misunderstandings, preferred a complaint against the petitioner on 05.08.2023. Based on the said complaint, the respondent registered a case against the petitioner for the offence under Section 12 of the POCSO Act in Crime No.387 of 2023. The respondent has completed the investigation and filed the final report, and the case is now pending trial in Special Sessions Case No.56 of 2024. Since the 2/5

respondent is not producing the witnesses, the trial is being delayed. He would submit that mandatory time frames are fixed under the POCSO Act for completion of the trial, whereas, the respondent is not cooperating for the completion of trial.

3.The learned Govt. Advocate (Crl.Side) for the respondent would submit that the case is now posted on 02.01.2026 for fixing date for trial and there are nine witnesses in the case.

4.Heard the learned counsel for the petitioner as well as the learned Govt. Advocate (Crl.Side) for the respondent. 5.As per the mandate of the POCSO Act, the trial shall be completed within a period of one year. Taking into consideration the fact that the case has been pending from 2024, a direction is issued to the learned Special Judge, Special Court for Exclusive Trial of Cases under the POCSO Act, 3/5

Chennai, to complete the trial as expeditiously as possible preferably within a period of three months from 02.01.2026.
