Prayer:- Writ petition filed under Article 226 of the Constitution of India praying for issuance of a writ of Mandamus directing the respondents to pay the pending amount of difference of Service Gratuity of Rs. 64,260/- difference of Leave salary of Rs. 40,284/- and Rs. 23,718/- surrender value of Earned Leave amount to the petitioner as communicated as reply under Right to Information Act 2005 along with interest at the rate of 6 percent per annum payable from the date of retirement in the light of Judgment passed by this Honble High Court on 18.10.2024 in WP No. 30627 of 2024 within the time that may be stipulated by this Honble court. 1/5

O R D E R
This Writ Petition has been filed for a direction directing the respondent to pay the pending amount of difference of Service Gratuity of Rs. 64,260/- difference of Leave salary of Rs. 40,284/- and Rs. 23,718/- surrender value of Earned Leave amount to the petitioner as communicated as reply under Right to Information Act 2005 along with interest at the rate of 6 percent per annum payable from the date of retirement in the light of Judgement passed by this Hon'ble High Court on 18.10.2024 in WP No.30627 of 2024 within the time that may be stipulated by this Hon'ble court.
2. Heard the learned counsel for both sides and perused the materials available on record.
3. The petitioner was initially appointed as a Helper in the respondent Corporation and was subsequently promoted to the post of Special Grade Canteen Helper. Upon attaining the age of superannuation, 2/5
she retired on 30.04.2020. However, the petitioner was not paid the difference in Service Gratuity of Rs.64,260/-, the difference in Leave Salary of Rs.40,284/-, and the surrender value of Earned Leave amounting to Rs.23,718/-. The above amounts were also confirmed through information furnished to the petitioner under the provisions of the Right to Information Act.

In view of the above, the respondents are directed to pay the eligible amount to the petitioner together with interest at the rate of 6% per annum for the belated period in settling the terminal benefits commencing from the date of the retirement till the date of actual disbursement within a period of twelve weeks from the date of receipt of a copy of this order.
5. With the above directions, this Writ Petition is disposed of. No costs.
