ORDER
This petition has been filed seeking a direction to the 1st respondent to remove the entire sand stored in the patta lands of the petitioner in SF.No.142 / 1A and 142 / 1 c1 measuring an extent of 1.22.5 Hectares (3.02 Acres ) in Thalavai North Revenue Village, Sendurai Taluk, Ariyalur District and consequently direct the respondents to pay the arrears of rent payable to the petitioner.
2. It is the case of the petitioner that the respondents approached the petitioner to give his land for the purpose of sand storage yard, for which, the same was given on lease agreement dated 30.07.2022 and subsequently, renewed periodically on 29.06.2023, 24.05.2024, 25.04.2025 and 25.07.2025 and the same was renewed and thus the lease will get over by 24.12.2025. however, there are arrears of rent and further the petitioner needs the land for his own purpose. Hence, the petitioner has sought to remove the entire sand stored in the patta lands of the petitioner in SF. No.142/1A & 142/1C1 measuring an extent of 1.22.5 Hectares (3.02 Acres) in Thalavai North Revenue Village, Sendurai Taluk, Ariyalur District and consequently, direct the respondents to pay the arrears of rent payable to the petitioner and the same is not considered. Hence, he filed the present writ petition.
3. The learned counsel for the petitioner submitted that this Court may direct the respondents to consider and pass orders on the petitioners representation within the stipulated time as fixed by this Court.
4. The learned Advocate General appearing for the respondent submitted that the lease period has been expired on 20.09.2025. The petitioner's possession will be handed over to him within the stipulated time as fixed by this Court.
5. Heard the learned counsel for both side and perused the materials available on record.
6. Recording the submission made by the learned Additional Advocate General, this court directs the respondents to hand over the vacant possession to the petitioner within a period of four weeks from today and settle all the arrears to him.
