ORDER
This writ petition has been filed challenging the online rejection order passed by the second respondent dated 28.06.2025 and for a consequential direction to the second respondent to issue patta in the name of petitioner and others, with respect to the subject property.
2. Heard Ms.B.Rathika Boopathi, learned counsel appearing for the petitioner and Mr.C.Jayaprakash, learned Government Advocate appearing on behalf of the respondents.
3. The petitioners and two others are claiming right and title over the property through a sale deed dated 14.09.2023 registered as Document No.3163 of 2023. They submitted an application on 13.06.2025 seeking for transfer of patta. The same has been rejected through online rejection order, without assigning any reasons. Aggrieved by the same, the present petition has been filed before this Court.
4. In the considered view of this Court, the impugned online rejection order is in violation of principles of natural justice. The online rejection 2/5
order does not even state the reasons for the rejection of the application. The learned Government Advocate, on instructions, submitted that as against the petitioner and two others, a civil suit is pending. If that is the case, the second respondent ought to have called the petitioner and two others for enquiry and got the necessary clarifications. However, without doing so, the second respondent cannot reject the application, without assigning any reasons.
5. In view of the above, the impugned rejection order dated 28.06.2025, issued by the second respondent is hereby quashed and the matter is remanded back to the file of the second respondent. The second respondent is directed to conduct an enquiry, afford an opportunity of hearing to the petitioner and the interested parties, and take a reasoned decision within a period of four weeks from the date of receipt of a copy of this order.
6. In the result, the writ petition is allowed in the above terms. No costs. Consequently, connected miscellaneous petition is closed. 19.11.2025 3/5
