ORDER

The Petitioner, who was arrested and remanded to judicial custody on 29.10.2025 for the alleged offences punishable under Section 329(4), 296(b), 140(2), 308(4) of BNS, in Crime No.218 of 2025 on the file of the 1/4

respondent police, seeks bail.

2. The case of the prosecution is that on 28.10.2025 the defacto complainant alleged that a group of unknown persons forcibly entered his residence, assaulted and threatened him and his brother with deadly weapons, robbed valuables and cash amounting to Rs.40,000/-, and thereafter kidnapped him using a car and his own vehicle. It is alleged that during transit, the assailants assaulted him, made ransom calls demanding Rs.3 crores, and subsequently abandoned him along with the vehicle. After he called his brother and his brother took him to the Government Hospital and left to his house out of fear. Hence, the case.

3. Learned counsel appearing for the petitioner submitted that the petitioner is an innocent person and she has been falsely implicated in this case. He would further submit that the petitioner was arrested and he is in judicial custody from 29.10.2025 and is ready to abide by any conditions that may be imposed by this Court. Hence, he prayed for grant of bail to the petitioner.

4. Learned Government Advocate (Crl.Side) appearing for the respondent police submitted that totally 10 accused in this case, this petitioner is ranked as A9, 8 accused still absconding, investigation in this 2/4

case is not completed, and he opposed for grant of bail to the petitioner.

5. Heard both sides and perused the materials available on record including the First Information Report.

6. Considering the facts and circumstances of the case and the submissions made by both counsel and also considering gravity of offences committed by the petitioner, the investigation is not yet completed and if he is released on bail, there is possibility of tampering the witnesses and hampering the investigation, this Court is not inclined to grant bail to the petitioner.
