ORDER

(Order of the Court was made by the Hon'ble Chief Justice) Heard learned counsel for the parties.

2. In view of the averment contained in paragraph 4 of the affidavit filed in support of the petition that the alleged construction is being made on the land which is classified and designated as road in the revenue record, we direct the Tahsildar concerned to conduct survey and verify the allegation. If it is found, upon survey, that the land is recorded as road, appropriate proceedings for removal of encroachment shall be taken and the proceedings be concluded within a period of three months from the date of receipt of a copy of this order. We make it clear that, if any such proceedings are drawn, the persons who are alleged to be the encroachers, shall be

afforded an opportunity of hearing by issuance of notice.
