ORDER

This writ petition has been filed challenging the order passed by the second respondent dated 29.09.2025, thereby rejecting the request made by the petitioner seeking promotion and also ordered for internal enquiry.

2. Heard the learned counsel on either side and perused the materials available on record.

3. The petitioner had joined in the second respondent Mill on 03.10.1996. Now, he is working as a Shift Supervisor. While being so, the petitioner submitted several representations seeking promotion to the post of Factory Manager applying the rule of reservation under SC/ST roster. However, it was rejected by an order dated 29.09.2025.

The learned counsel for the petitioner submitted that as per the Subsidiary Regulation 17(a) of the second respondent Mill, the post of Shift Supervisor is the feeder category for promotion to the post of Assistant Spinning Master. The promotion procedure mandates merit-cum-seniority among eligible employees in the feeder category. Further, the post of Factory Manager is a promotional post to be filled through regular promotion from eligible in-service

employees. However, the second respondent appointed the Factory Manager on a contractual basis and it is in contravention of the Subsidiary Regulation 17(a) of the second respondent.

5. A perusal of the impugned order dated 29.09.2025 and also on the submissions made by the learned Government Advocate reveals that the petitioner belongs to Tamil Nadu. Even at the time of his appointment, he was wrongly appointed, since the post was meant for Karaikal region. Therefore, the representation submitted by the petitioner was rejected, on the ground that the appointment of the petitioner itself is invalid ab initio, since the petitioner belongs to Tamil Nadu. Thereafter, the petitioner was issued with memorandum on 03.07.2025 and 14.08.2025.

6. On receipt of the same, the petitioner also submitted explanation and it was not satisfactory in nature. Therefore, now, the respondents had decided to initiate an enquiry as per the Subsidiary Regulations. When the appointment of the petitioner is in question, the petitioner cannot seek for any promotion to the post of Assistant Spinning Master. Further, the promotion is not a matter of right and as such, the petitioner's request was rightly rejected and this Court finds no infirmity or illegality in the order passed by the second respondent.

7. In view of the above, the writ petition is devoid of merits and is liable to be dismissed. Accordingly, this writ petition is dismissed. No costs. 19.11.2025 Internet: Yes Index : Yes/No Speaking/Non Speaking order mn
