PRAYER Writ Petition filed under Article 226 of the Constitution of India to issue a writ of mandamus, directing the Respondent Nos. 1 to 5 to provide adequate police protection to remove the illegal construction of concrete structure obstructing the pathway in Survey No.344/1A, and Patta No.04 at Sendhamanagalam Taluk Marurpatti Village, Namakkal District without any hindrance based on the proceedings by the Respondent No.5 in Na.Ka.2657/2022(Aa2) dated 09.05.2022 and Na.Ka.3391/2024/A5 dated 27.11.2024 and to take appropriate legal action against the Respondent Nos.6 and 7 by considering the petitioner's representation dated 25.03.2025.

ORDER
This writ petition has been filed seeking a direction to respondents 1 to 5 to provide adequate police protection for the removal of the alleged illegal concrete structure put up in the pathway situated in Survey No.344/1A, covered under Patta No.04, at Marurpatti Village, Sendhamangalam Taluk, Namakkal District, based on the proceedings of the fifth respondent in Na.Ka.No.2657/2022(Aa2), dated 09.05.2022 and Na.Ka.No.3391/2024/A5,
dated 27.11.2024, and consequently to take appropriate action against respondents 6 and 7 by considering the petitioner's representation dated 25.03.2025.
2. Heard the learned counsel appearing for the petitioner, the learned Government Advocate appearing for the respondents 1 to 5 and the learned counsel appearing for respondents 6 and 7.
3. It is seen that there is a dispute between the petitioner and respondents 6 and 7 with regard to the subject property. According to the petitioner, the subject land is a common pathway and respondents 6 and 7 have put up a compound wall, thereby obstructing access to the petitioner's property. On the other hand, respondents 6 and 7 claim that the land belongs to them and that patta has been issued in their favour.

In view of the rival claims relating to title and possession over the subject property, this Court is of the view that the dispute involves disputed questions of fact, which cannot be adjudicated in proceedings under Article 226 of the Constitution of India. The petitioner is at liberty to approach the competent Civil Court and work out his remedy in the manner known to law.
