PRAYER : Criminal Original Petition is filed under Section 528 of Bharatiya Nagarik Suraksha Sanhita/Section 482 Cr.P.C. to call for the records in S.T.C.No.775 of 2023 on the file of the learned Chief Judicial Magistrate court, Tiruvarur and quash the same by allowing this Criminal Original Petition.

O R D E R

This Criminal Original Petition has been filed seeking to quash the S.T.C.No.775 of 2023 on the file of the Chief Judicial Magistrate Court, Tiruvarur.

The case of the prosecution is that on 22.09.2022 at about 12.15 hours, when the complainant and other police officers were patrolling near Tiruvarur railway bridge, the petitioners and other accused were protesting against the NIA police officials for the reason of raid in the houses and offices of some Muslim Organization and investigating the 2/5

same. Further, the petitioners and other accused, without prior permission from the authorities, have gathered in public place and were raising protest against NIA police officials. The learned counsel appearing for the petitioner would submit that the facts of the instant case are similar to the facts of the cases in Jeevanandham and others vs. The Inspector of Police, Velayuthampalayam Police Station, Karur District reported in (2018 2 LW (Crl) 606) and Sri Raja vs Inspector of Police, Sivakasi Town Police Station Virudhunagar District and others (Crl.O.P(MD) No.7922 of 2019, decided on 30.08.2019) and hence, the said two decisions would apply on all fours to the instant case.

3. The learned Government Advocate (Crl.Side) appearing for the first respondent would endorse the aforesaid submission.

4. In view of the above submissions made on either side, this Court is of the opinion that no useful purpose will be served by keeping the 3/5

proceedings pending.

5. Accordingly, the Criminal Original Petition stands allowed and the proceedings in S.T.C.No.775 of 2023, on the file of the Chief Judicial Magistrate Court, Tiruvarur, is hereby quashed. Consequently, connected miscellaneous petitions are also closed.
