ORDER

This writ petition has been filed challenging the order of compulsory retirement passed by the second respondent dated 17.05.2025.

2. Though the petitioner filed this writ petition, he also filed an appeal as against the order passed by the second respondent before the first respondent and it is pending. Therefore, when the petitioner filed appeal before the first respondent and while pendency of the said appeal, the petitioner cannot simultaneously challenge the order passed by the second respondent before this Court by invoking Article 226 of the Constitution of India. Therefore, the writ petition is devoid of merits and not maintainable. Hence, it is dismissed. 2/5

The first respondent is directed to consider the appeal filed by the petitioner and dispose of the same on merits and in accordance with law after affording opportunity of hearing to the petitioner and counter parties, within a period of twelve weeks from the date of receipt of a copy of this order.
