This criminal original petition has been filed to call for records relating to charge sheet vide C.C.No.39 of 2025 pending on the file of the Judicial Magistrate - II, Mettur, Salem and quash the same. 2.When the matter was taken up for hearing today, the learned Govt. Advocate (Crl.side) submitted that the trial has already commenced and two witnesses have been examined.

3.The learned counsel for the petitioner would submit that personal appearance of the petitioner before the trial Court may be dispensed with. 2/5

4.In view of the above, this Court is not inclined to interfere with the original trial proceedings. However, considering the request made by the learned counsel for the petitioner, the personal appearance of the petitioner before the trial Court is dispensed with, except for the dates when his presence is specifically required by the trial Court for the purpose of examination under Section 313 Cr.P.C., or for any other valid reason.
