ORDER
The writ petition has been filed for a direction directing the respondents to disburse the differential sum of Gratuity and Leave Encashment benefits to the petitioner based on Dearness Allowance revision with effect from 01.01.2024 with interest at the rate of 8% per annum from the said date of entitlement to till the date of actual disbursement.
2. The petitioner joined in the service as a Junior Tradesman on 11.04.1988 in the respondent Corporation. Thereafter, he retired from service on 29.02.2024. On 01.07.2023, 46 % dearness allowance of basic pay was granted for the Transport Employees. However, with effect from 01.01.2024, it was revised to 50% of basic pay. While calculating the retirement benefits, the said increase of 4% was not considered . Therefore, the petitioner is entitled for difference in terminal benefits.
3. In view of the above, the respondents are directed to disburse the differential sum of Gratuity and Leave Encashment benefits to the petitioner based on Dearness Allowance revision with effect from 01.01.2024 with interest at the 2/4
rate of 6% per annum from the said date of entitlement to till the date of actual disbursement, within a period of 6 weeks from the date of receipt of copy of this order.
