Criminal Original Petition filed under Section 528 of BNSS, 2023 to direct the respondents not to harass the petitioners and their family members and under the guise of alleged written acceptance which has been obtained forcefully from the petitioners.

ORDER
This criminal original petition has been filed seeking to direct the respondent not to harass the petitioner under the guise of enquiry, without following the due process of law.
2. The learned counsel for the petitioners submits that a counter complaint been given against the complainant.
3. The learned Government Advocate (Criminal Side) appearing for the respondents 1 and 2, on instructions, submitted that the current paper enquiry is pending in C.No.G4/5276/153/2025 and based on the complaint lodged against the petitioners, the second respondent is conducting the enquiry and that the petitioners are not being unnecessarily harassed, and that they have been called only for enquiry.
4. In such circumstances, it is for the Investigating Agency to issue appropriate notice to the petitioners under Section 35(3) of BNSS for enquiry and on receipt of such notice, the petitioners shall appear for enquiry and co-operate in the investigation. It is made clear that the petitioners shall 2/4
not be harassed during the course of enquiry. If any cognizable offence is made out, the second respondent shall register a First Information Report and proceed in accordance with law.
5. Accordingly, this criminal original petition stands disposed of. 08.12.2025 rap NCC : Yes/No 3/4
