Public Prosecutor for R2 & R3 Order According to the petitioner, she is a Srilankan and is staying in the Srilankan Tamils Rehabilitation Camp, Chinnapallikuppam, Thirupathur District. She was not brought under adverse remarks while staying in India. While so, she is entitled to leave the country and return to Srilanka. The petitioner wishes to return to Srilanka and so, she applied for Exit Permit before the 1st respondent. At that time, she was informed that she is a witness in a case in S.C.No.13 of 2021 pending before the Court of District and Sessions Judge, Tirupathur. Therefore, the petitioner has filed this petition praying for a direction to permit her to appear and depose through video conferencing in S.C.No.13 of 2021 whenever required and direct the 1st respondent to grant Exit Permit to her, thereby enabling her to travel to Srilanka. __________Page 2 of 7
2. When the matter was listed on 11.12.2025, it was submitted by the learned Addl. Public Prosecutor for respondents 2 and 3 that the petitioner's evidence has been completed before the trial court and the accused has also reported that he is not cross-examining the petitioner, thereby there is no requirement for her to stay in India. This Court directed Mr.V.Chandrasekaran, learned Senior Panel Counsel appearing for 1st respondent to get instructions from the 1st respondent.
3. Today, a communication dated 12.12.2025 addressed by the 1st respondent to Mr.V.Chandrasekaran, learned Senior Panel Counsel is produced before this court.

Mr.Janaa Balaaji A.B., representing Mr.V.Chandrasekaran, learned Senior Panel Counsel would submit that the 1st respondent has sent a letter dated 23.10.2025 to the 2nd respondent seeking no objection to issue Exit Permit to the petitioner and if no objection is given by the 2nd respondent, the Exit Permit can be processed further by the office of the 1st respondent.
5. At this juncture, Mr.D.Mario Johnson, learned counsel for petitioner submitted that the passport of the petitioner is expiring on 17.12.2025. __________Page 3 of 7

For the sake of ready reference, the communication dated 12.12.2025 sent by the 1st respondent to the learned Senior Panel Counsel is extracted hereunder :- "Sir, Sub: WP Crl. 1424/2025 - Sayanthini vs. FRRO, Chennai & ors. Please refer to your email dated 11.12.2025 regarding the above mentioned case.

The petitioner, who is Sri Lankan National has applied for exit permit with the 1st respondent on the strength of her Sri Lankan Travel Document bearing No.NM8047630, which is valid till 17.12.2025. Our record check revealed that she has entered India on the strength of Sri Lankan Passport bearing No. N7632094 and Indian Tourist Visa (VK9657122) on 23.11.2018. As her Indian visa got expired on 13.02.2019, she has been overstaying since 14.02.2019. 2.
One Letchumy, mother of the petitioner, meet with a fire accident under suspicious circumstances on 03.08.2019, when one Karunakaran, step brother of the petitioner and also son of Letchumy died in hospital on 24.08.2019. The petitioner filed a complaint before Umarabad Police Station, then in Vellore District (now Tirupattur District), regarding the incident. The same was registered as FIR No. 274/2019 under Sec.174 Cr.P.C. The case is now pending trial before the Principal District Judge, Tirupattur as S.C.No. 13 of 2021 under Section 302 I.P.C., and the said Karunakaran has been charge-sheeted as the accused.

In this regard, the 1st respondent has sent a letter dated 23.10.2025 to 2nd respondent seeking "No Objection" to issue Exit Permit to the petitioner. It is submitted that on receipt of No Objection from the 2nd respondent the exit can be processed further by the office of the 1st respondent.

Therefore, the Hon'ble High Court may be informed accordingly and may kindly be requested for the dismissal of the case."

In view of the above, taking into consideration the fact that passport of the petitioner gets expired on 17.12.2025, the 2nd respondent shall issue No Objection Certificate by 12.00 noon on 16.12.2025 and the same shall also be communicated to the 1st respondent by fax or email so that the 1st respondent can issue Exit Permit immediately so as to enable the petitioner to leave India for Sri Lanka before the expiry of her passport.
8. With the above direction, this Writ Petition (Crl.) stands disposed of. No costs.
