ORDER

This criminal original petition has been filed to call for the records relating to crime No.353 of 2024 on the file of the 1 st respondent and quash the same.

2.The case of the prosecution is that the 2 nd respondent /de facto complainant preferred a complaint before the 1 st respondent against the petitioner and 6 others alleging that on 31.07.2024 at about 8.00 a.m. the petitioner's 2 nd wife, who is arrayed as the 2 nd accused viz., Gnanamani @ Ammu, had arranged 1 st Accused viz. Vaijeyanthimala to kidnap the newly born baby. Accordingly, A1 along with her minor son, kidnapped the de facto complainant's new born male child from the Government Hospital and handed over the child to A2 and A3 (Praveen Selvan @ Rinku) for 2/5

which they received a sum of Rs.2,00,000/-. The allegation against the petitioner is that he is the husband of A2 and despite knowing about the offence, he failed to disclose the same to the first respondent police. On this basis, the complaint has been lodged against the petitioner. 3.The learned counsel for the petitioner would submit that the second accused is the second wife of the petitioner. She had indulged in child trafficking. The petitioner, who has no role in the alleged offences, has been unnecessarily implicated.

4.The learned Govt. Advocate (Crl.Side) for the first respondent would submit that it is a clear case of child trafficking and a new born child was lifted from the hospital. A1 kidnapped the child from the hospital and handed it over to A2; A2, in turn, handed over the child to the petitioner, who, thereafter passed on the child to A5. Investigation is still pending and a prima facie case has been made out against the petitioner. 5.Heard the learned counsel for the petitioner as well as the learned 3/5

Advocate (Crl.Side) for the first respondent. 6.Considering the fact that serious allegation of child trafficking has been raised, the investigation is still in progress, and that the materials collected so far disclose a prima facie case against the petitioner, this Court is not inclined to interfere with the investigation at this stage.
