ORDER

The petitioners, who apprehend arrest for the alleged offences under Sections 303(2) of BNS, 2023 and Section 21(1) of Mines & Minerals (Development & Regulation) Act, 1957, in Cr.No.164 of 2025 on the file of the respondent police seeks anticipatory bail.

2.The allegation against the petitioners is that the petitioners were involved in illegal quarrying and transportation of 20 tonnes of granite stones. Hence, the case.

3. The learned counsel appearing for the petitioners submitted that the petitioners have not committed any offence as alleged by the prosecution and they have been falsely implicated in this case. Hence, he prays for grant of anticipatory bail to the petitioners.

4.The learned Government Advocate (Crl.side) for the respondent reported that the petitioners illegally quarried and stole high-value granite stones using a lorry. He further submitted that the investigation is not yet

completed. He would submit that if they are released on anticipatory bail, they would hamper investigation and tamper the witnesses. Hence, he vehemently opposed to grant anticipatory bail to the petitioners.

Considering the nature of the allegation and the fact that the huge quantity of granite stones have been illegally quarried by the petitioners and the fact that the investigation is not yet completed and so, at this stage, if they are released on anticipatory bail, they may abscond and there is possibility of hampering investigation, hence this Court is not inclined to grant anticipatory bail to the petitioners.
