ORDER

This application is filed seeking to permit the applicant to re-open the defendants' side evidence made in C.S.No.243 of 2021.

2. The applicant herein is the third defendant in the suit, and without recording the evidence on the side of the applicant/D3, the evidence on the side of the defendants, was closed. Now, the applicant wants to examine D3, who is the vital witness to prove the case of the defendants and hence, this application is filed.

3. The respondents 1 and 2 have no objection for allowing this application, provided the evidence has to be completed within the time limit. Recording the same, this application is allowed. The applicant/D3 is directed to 2 / 4

appear before the concerned Master on 21.11.2025. The plaintiffs' side counsel is ready to cross-examine the witness on the same day.

4. The Master concerned, shall complete the recording of the evidence.

5. List the suit before the concerned Master and after completion of recording of evidence, the suit is directed to be posted before the Court on 27.11.2025.
