O R D E R

This writ petition has been filed to call for the records pertaining to the order passed by the second respondent in Ref.No.86/2022 dated 19.09.2025 and quash the same, consequentially directing the second respondent to receive and register the settlement deed dated 09.03.2023 presented by the petitioners pertaining to S.F.No.71/2, Thoppampatti Village, Pollachi Taluk, Coimbatore District.

2. Mr.Stalin Abhimanyu, learned Additional Government Pleader takes notice on behalf of respondents 1 & 2. Mr.N.R.R.Arun Natarajan, learned Special Government Pleader takes notice on behalf of third respondent and suo-motu impleaded fourth respondent. By consent of both the parties, this writ petition is taken up for final disposal at the stage of admission itself.

Learned counsel for the petitioner submitted that the property comprised in S.No.71/2 to an extent of 3.86 1⁄2 acre, situated at Thopampatti Village, Pollachi Taluk, Coimbatore District belongs to petitioner's father, who settled the said property by way of settlement deed in favour his daughter viz., Vithyaa Raajamanickam, the petitioner herein. Thereafter, the petitioner decided to settle the same in favour of her husband and executed a settlement deed dated 09.03.2023, which was presented before the second respondent for registration. However, the second respondent refused to register the same by issuing an order dated 19.09.2025 in Ref No.86/2022, citing the reason that the aforesaid property belongs to fourth respondent/temple and sought No-Objection Certificate from the third respondent for registering the same. Challenging the said order dated 19.09.2025, the petitioner has come forward with the present writ petition.

4. Learned Special Government Pleader appearing for the respondents 3 & 4 would fairly submit that due notice will be issued to the petitioner as well as the respondents 3 & 4 and thereafter, the matter will be decided.

5. Heard the learned counsel on either side and perused the materials available on record.

Admittedly, the petitioner has presented the settlement deed for registration, however, the second respondent refused to register the same seeking No-Objection Certificate from the third respondent, since the subject land belongs to fourth respondent/temple. Under these circumstances, the second respondent ought to have issued notice to the petitioner as well as the respondents 3 & 4 and decided the matter, whether to register the settlement deed or not. But, in the case on hand, the second respondent has not issued notice to both the parties and not conducted an enquiry.

7. In view of the above, this Court is inclined to set aside the impugned order dated 19.09.2025. Accordingly, the said order is set aside. Consequently, this Court directs the second respondent to take a decision in regard to the registration of settlement deed, after issuing due notice to the petitioner as well as the respondents 3 & 4 and thereafter, register the said deed in accordance with law.

Accordingly, this writ petition stands disposed of. No costs. 20.11.2025 Note: Registry is directed to carry out necessary amendment in the cause title.
