ORDER

This application has been filed by the applicant to permit the applicant to file additional documents.

2. According to the applicant, he is the petitioner in the main petition filed for custody of the minor children. Already the evidence of PW1 was recorded. The case is posted for examination of plaintiff side evidence. During the course of preparation of evidence, the petitioner realised that vital documents like Pay Slips and 2/6

some photographs were inadvertently not filed along with the original petition. Therefore, in order to prove the case of the petition, those documents are essential to prove the case. Therefore, filed this application.

3. The learned counsel for the respondent strongly opposed to allow this application and the petition mentioned documents are prior to the filing of the original petition and the petitioner has not stated any reasons for non production of documents along with the petition. Moreover, all the documents are not relevant to this case and therefore, strongly objected.

4. Considering the nature of application and the evidence has not been recorded so far and there is no filing affidavit, this application is filed to include the documents. As far as the admissibility, relevancy and proof, it cannot be tested through this application. This application is filed only to grant leave for production of documents belatedly. Therefore, this petition is allowed and the documents can be received subject to proof, relevancy and admissibility. The respondent is at liberty to 3/6

raise any objections at the time of marking the documents in all aspects.

5. Post the matter before the learned Master for recording evidence on 16.12.2025. The learned Master is directed to strictly comply the orders passed by this Court in granting adjournments.
