The Sub Registrar Edappadi Sub Registrar Office, Edapadi Post And Taluk, Salem-637 101 ..Respondent(s) PRAYER: This writ petition is filed under Article 226 of the Constitution of India praying to issue a writ of Certiorarified Mandamus calling for the records relating to the impugned Refusal check slip of the 2nd respondent in Refusal No.RFL/Edappadi/27/2025, dated 8.4.2025 and quash the same as illegal and arbitrary and consequently direct the 2nd respondent S.R.O., Edappadi, Salem District to Register the Settlement Deed dated 8.4.2025 presented for Registration, within a stipulated time as fixed by this Court.

ORDER
The petitioner's grandfather, Aanai Gounder, executed a Will dated 09.03.2011 bearing document No.18/2011. Under the said document, land was bequeathed in favour of his two grandsons in equal shares. One of the grandsons, S.Kannans, approached this Court against a refusal check slip issued when he endeavoured to register the settlement deed dated 31.05.2024. By order dated 24.07.2024, this Court directed the second respondent to register the settlement deed after quashing the refusal check slip.
2. On the ground that he is entitled to similar treatment, the other grandson, V.Prakash, has approached this Court by this writ petition.
3. Learned Special Government Pleader points out that a settlement deed was executed in favour of the daughter of the testator. In response, learned counsel for the petitioner submits that such settlement deed was cancelled under document No.3582/2010, which was also discussed in the earlier order of this Court.

On perusal of the order dated 24.07.2024 in W.P.No.20179 of 2025, it is evident that the said matter pertains to the refusal check slip issued to S.Kannan when he sought to register a settlement deed on the basis of Will dated 09.03.2011, which also forms the subject of this writ petition. Therefore, the petitioner herein is entitled to parity.
5. The request of registration was declined inter alia by citing the settlement deed which was cancelled on 11.10.2010 under document No.3582/2010. Therefore, the refusal check slip cannot be sustained and is hereby set aside. The petitioner is permitted to re-present the settlement deed for registration within two weeks from the date of receipt of a copy of this order. Within two weeks therefrom, subject to fulfilment of other requirements relating to registration, the registration shall be effected.
