PRAYER This writ petition is filed under Article 226 of the Constitution of India, seeking for a writ of Certiorari, calling for the records pertaining to the proceedings of the 3rd respondent dated 18.02.2025 in Na.Ka.No.853/ mines/2019 and to quash the same.

ORDER
This writ petition is filed to call or the records pertaining to the proceedings of the 3rd respondent dated 18.02.2025 in Na.Ka.No.853/ mines/2019 and to quash the same.
2.The learned counsel appearing for the petitioner would submit that the petitioner is the resident of Pachapalayam Village, Nachipalayam Palathurai (post) Coimbatore - 641 105. The sixth respondent is the owner of the land in S.F.No.116/2B1C in the said Village. She made an application to the third respondent for grant of license for quarrying rough stones in the said land. Pursuant thereto, the third respondent vide the impugned order dated 18.02.2025 has granted license to the sixth respondent to quarry rough stones in S.F.No.116/2BIC. Challenging the same, the present writ petition is filed with the above said prayer.
3.The learned counsel for the petitioner would submit that the third respondent has granted mining licence contrary to the norms prescribed by the
Tamil Nadu Minor Mineral Concession Rules and therefore, objecting the same, the petitioner made a representation before the first respondent on 12.08.2025 and thereafter, a direction was also issued by the first respondent to the third respondent to conduct an enquiry on the petitioner's representation dated 12.08.2025. However, no action has been taken by the third respondent till date. Hence, he prays that a direction be issued to the third respondent to consider the representation of the petitioner dated 12.08.2025 and to pass appropriate orders, after proving an opportunity of hearing to the petitioner and also the sixth respondent, within a stipulated period as fixed by this Court. 4.Per contra, the learned Additional Government Pleader would submit that since the petitioner has come forward to restrict his relief to direct the third respondent to consider the representation of the petitioner dated 12.08.2025, the third respondent will consider the representation of the petitioner dated 12.08.2025 and pass appropriate orders, within a stipulated time as fixed by this Court.
5.Heard the learned counsel on either side and perused the materials available on record.
6.Since no adverse order is passed against the sixth respondent, notice to the sixth respondent is dispensed with.
7.Considering the limited relief sought for in this writ petition, without interfering with the impugned order, this Court now directs the third respondent to consider the representation of the petitioner dated 12.08.2025 and to pass appropriate orders, in accordance with law, after providing an opportunity of hearing to the petitioner as well as the six respondent, within a period of twelve (12) weeks from the date of receipt of a copy of this order. 8.The writ petition is disposed of accordingly.
