..Respondent Prayer: Writ Petition is filed under Article 226 of the Constitution of India praying for issuance of Writ of Certiorarified Mandamus calling for the records relating to the refusal check slips dated 01.11.2025 bearing Refusal Nos.RFL/Ambattur/36/2025 and RFL/Ambattur/37/2025 issued by the respondent, quash the same and consequently direct the respondent to register the petitioner's two settlement deeds without insisting on production of the

original title deed or the registered joint venture agreement upon payment of necessary stamp duty and registration fees.

ORDER

The petitioner is 91 years old. He executed two settlement deeds in favour of his daughter and daughter's son, respectively, and presented the same for registration. The request for registration was declined under the impugned refusal check slips on the ground that the petitioner failed to produce the parent document.

2. Mr.U.Baranidharan, learned Special Government Pleader, accepts notice for the sole respondent. Because the parent document was registered before a different Sub-Registrar's office, he submits that the petitioner may be directed to provide a certified copy thereof.

3. In response, learned counsel for the petitioner submits that a photo copy of such certified copy has been enclosed in the typed set and that the certified copy would be submitted.

4. The settled legal position is that the registration cannot be declined on the ground that the original parent document has not been submitted. Therefore, the refusal check slips cannot be sustained and are hereby set aside. The writ petition is, consequently, disposed of on the following terms: (i) The petitioner shall submit a certified copy of sale deed dated 25.09.1971 bearing document no.4927/1971 within one week from the date of receipt of a copy of this order.

(ii) Within one week therefrom, the Sub-Registrar/respondent herein shall take necessary measures to register the two settlement deeds, subject to the fulfilment of other requirements in this regard. There will be no order as to costs.
