ORDER

Writ petition is filed for a writ of mandamus, directing the respondents 1 to 3 to consider the petitioner's representation dated 11.03.2025, and to regularize the petitioner's services and settle the back wages and all other monetary benefits as per the order of the 4th respondent dated 16.05.2022. 2.Mrs.M.Jayanthy, learned Additional Government Pleader accepts notice on behalf of the respondents. With the consent of the learned counsels on both sides, the writ petition is taken up for final disposal at the admission stage. 3.The petitioner was working in the 1st respondent farm since 27.03.1995, as labourer on wages of Rs.330/- per day. The petitioner contended that she was entitled to regularization of her employment under the provisions of Section 3(1) of the Tamil Nadu Industrial Establishments [Conferment of Permanent Status to Workman] Act, 1981. The petitioner along with other workmen approached the 3rd respondent for regularization of her services, but the 3rd respondent gave evasive replies. The petitioner contended that she approached the Assistant 2/6

Commissioner of Labour, Coimbatore, for permanency, invoking the provisions of the Tamil Nadu Industrial Establishments [Conferment of Permanent status to Workmen] Act, 1981, and the authority, on 16.05.2022, ordered in favour of the petitioner. Thereafter, the petitioner submitted her representation on 11.03.2025, to the respondents 1 to 3, to regularize her services and to settle all monetary and other benefits. Since no action was taken on the petitioner's representation, the petitioner filed the above writ petition for the aforesaid relief. 4.Heard both sides and perused the material placed on record. 5.It is seen that the Assistant Commissioner of Labour, Coimbatore on 16.05.2022, passed an order in favour of the petitioner under Section 3 of the Act. The petitioner approached the respondents for compliance of the said order. However, the respondents evaded compliance. The petitioner has therefore filed the above writ petition.

6.The learned counsel for the petitioner submitted that even though the petitioner has prayed for a mandamus, to regularize her services as per the order of the 4th respondent dated 16.05.2022, it would suffice, if a direction is issued to the 1st respondent to consider the petitioner's representation dated 11.03.2025, and pass appropriate orders, within the time fixed by this Court. 3/6

7.Considering the limited prayer of the learned counsel for the petitioner and without going into the merits of the case, a direction is issued to the 1st respondent to consider the petitioner's representation dated 11.03.2025, on merits and in accordance with law, and pass appropriate orders, within a period of four weeks, from the date of receipt of a copy of this order.
