Criminal Miscellaneous Petition filed under Section 528 of BNSS, 2023, to restore the above criminal original petition in Crl.OP.No.30028 of 2018 on the file of this Hon'ble Court which was dismissed for default on 29.06.2022.

ORDER

Vide order dated 29.06.2022 made in Crl.OP.No.30028 of 2018, this Court had dismissed the said criminal original petition for non-prosecution and this criminal miscellaneous petition has been filed seeking to restore the said petition in Crl.OP.No.30028 of 2018 to file.

2. Even today, when the matter was taken up for hearing, there was no representation on behalf of the petitioners. Hence, it is evident that the petitioners are not interested in pursuing the matter and their conduct reflects an intention to protract the proceedings, which cannot be countenanced.

3. In view of the above, this Criminal Miscellaneous Petition stands dismissed.
