ORDER

The petitioner, who was arrested and remanded to judicial custody on 09.10.2025, for the alleged offence punishable under Sections 406 & 420 of IPC, in Crime No.347 of 2023, on the file of the respondent police, seeks bail.

2. The allegation against this petitioner is that, this petitioner joining hands with other family members that is mother and brother, collected Rs.26 lakhs from the defacto complainant under the pretext of converting 4 crores of money invested in the name of the trust run by A1 to A3. Subsequently, they cheated the defacto complainant. It was revealed that they made a false promise and collected the money.

Learned counsel appearing for the petitioner submitted that the petitioner is alleged to have collected only Rs.40,000/- from the defacto complainant, and the remaining money was paid to the other accused. The petitioner is in custody from 09.10.2025. Hence, he prayed for grant of bail to the petitioner.

4. Learned Government Advocate (Crl.Side) appearing for the respondent police submitted that there are totally 3 accused in this case. A1 and A2 already 2/4

arrested and are in custody. A3 still absconding. So far, Rs.60,000/- has been recovered, and the investigation is pending. Hence, he opposed for grant of bail to the petitioner.

5. Heard both sides and perused the materials available on record including the First Information Report.

6. I have gone through the FIR and other connected materials, and it was revealed that petitioner not only collected money from the defacto complainant but also from other persons. In the statement of A1, it revealed that this petitioner also actively involved in collection of money on behalf of A1. Considering the manner in which the petitioner cheated the defacto complainant and also other persons, if the petitioner is granted bail, there is a likelihood that it would hamper the investigation. Hence, I am not inclined to grant bail to the petitioner. Accordingly, this Criminal Original Petition is dismissed. 17.11.2025 mpa 3/4
