ORDER
The petitioner, who was arrested and remanded to judicial custody on 20.08.2025, for the alleged offence punishable under Sections 294(b), 393, 394, 397, 506(ii) r/w 34 of IPC, in Crime No.104 of 2021, on the file of the respondent police, seeks bail.
2. The allegation against this petitioner is that, this petitioner was involved for the offences of robbery and earlier he was released on bail, subsequently, he was not appeared before the trial Court on 15.09.2025, hence NBW was issued and he was secured on 22.10.2025.
3. Learned counsel appearing for the petitioner submitted that the petitioner is an innocent person and he has been falsely implicated in another case in Crime No.516 of 2025 on the file of the Inspector of Police, T2 Ambattur Police Station, hence he was not able to appear before the trial Court, and hence NBW was issued. He has been secured on 22.10.2025. He would further submit that the petitioner was arrested and he is in judicial custody from 20.08.2025 and is ready to abide by any conditions that may be imposed by this Court. Hence, he prayed for grant of bail to the petitioner in this case also. 2/6
4. Considering the fact that the petitioner was in prison at the time of issuance of NBW, I am inclined to grant bail to this though it is stated that the petitioner is having 8 previous cases, and this Court is inclined to grant bail to the petitioner, subject to certain conditions.
5. Accordingly, the petitioner is ordered to be released on bail on his executing a bond for a sum of Rs.15,000/- (Rupees Fifteen Thousand only) with two sureties, each for a like sum to the satisfaction of the learned XVII Additional District & Sessions Court at Chennai, and on further conditions that:- [a] the sureties shall affix their photographs and Left Thumb Impression in the surety bond and the Magistrate may obtain a copy of their Aadhar card or Bank pass Book to ensure their identity;
[b] the petitioner shall report before the XVII Additional District & Sessions Court at Chennai daily at 10.30 a.m., for a period of two weeks;
[c] the petitioner shall not abscond either during investigation or trial;
[d] the petitioner shall not tamper with the evidence or 3/6
witness either during investigation or trial; [e] On breach of any of the aforesaid conditions, the learned Magistrate/Trial Court is entitled to take appropriate action against the petitioner in accordance with law as if the conditions have been imposed and the petitioner released on bail by the learned Magistrate/Trial Court himself, as laid down by the Hon'ble Supreme Court in P.K.Shaji vs. State of Kerala [(2005)AIR SCW 5560]; [f] If the accused thereafter absconds, a fresh FIR can be registered under Section 269 B.N.S.
