Respondents PRAYER : Petition filed under Article 226 of the Constitution of India seeking issuance of a writ of mandamus directing the 5th respondent herein not to convert the agricultural lands in S.F.No.288/2 and 3 of Iduvai Village, Tiruppur South Taluk, Tiruppur District for establishing a dumping yard for storing the solid wastes of Tiruppur Municipal Corporation without following the statutory laws and Rules in force.

ORDER

(Order of the Court was made by the Hon'ble Chief Justice) Heard learned counsel for the parties.

2. This public interest litigation has been filed seeking intervention of this Court in the matter of establishment of temporary dumping yard for disposal of solid wastes in Tiruppur on certain lands.

3. At the outset, learned Advocate-General, appearing for respondent No.5, informs the Court that the establishment of solid

waste dumping yard is being undertaken in compliance of the order passed by a learned Single Judge of this Court in W.P.No.37431 of 2025 [Velusamy P v. District Collector-Tiruppur District and others], where the Court, after having passed the order, is monitoring the establishment of dumping facility. The order dated 17.10.2025 passed in W.P.No.37431 of 2025 is also placed for perusal of this Court.

4. Since the action of the official respondents is towards compliance of the order and the proceedings in the pending writ petition, this public interest litigation is not maintainable.

5. The writ petition is dismissed. There shall be no order as to costs. Consequently, connected miscellaneous petition is closed. It is, however, open for the petitioner to seek intervention in the pending writ proceedings.
