PRAYER: Writ Petition filed under Article 226 of the Constitution of India, to issue a Writ of Certiorarified Mandamus, call for the records of the 3rd respondent in its proceedings Na.Ka.No.A10/2704/2023, dated : 24.10.2025 quash the same and consequently direct the 1st respondent to issue patta to the occupied portion of 21 sq.feet land in S.No.242/20 in Eraiyur Village, Vanur Taluk, Villupuram - 604 304 as per the order of this Court.

ORDER

[Order of the Court was made by S.M.SUBRAMANIAM, J.] Notice issued by the third respondent dated 24.10.2025 is under challenge in the present writ proceedings.

2. The Authorities during the course of survey found that the petitioner has encroached upon the adjacent land classified as 'lane'. Thus notice has been issued directing the petitioner to vacate the lane, failing which action will be initiated.

3. Instead of submitting his explanation, the petitioner has chosen to file the present writ petition.

4. High Court cannot decide the disputed issues and therefore, the petitioner has to submit his explanation along with the documents, if any and on receipt of the same, the Authorities Competent shall consider the same and take final decision on merits. If any encroachment of lane is identified, then it is to be 2/4

removed by following the procedures.

5. The learned Additional Government Pleader would submit that the petitioner has encroached over and above the land assigned in his favour.

6. The said factum has also to be verified and encroachment shall be removed by following the procedures to restore the Government land by vacating the encroachers. With these observations, this writ petition is dismissed. No costs. Connected miscellaneous petition is closed.
