The present Criminal Original Petition has been filed seeking to set aside the impugned docket order dated 26.05.2025 and to direct the learned Principal District and Sessions Judge, Tiruvallur, to number the petition in C.M.P.(SR) No.6254 of 2024 in S.C.No.44 of 2024 seeking return of the petitioner's property.

The case of the petitioner is that he is an accused facing trial in S.C.No.44 of 2024, on the file of the learned Principal District and Sessions Judge, Tiruvallur, in connection with Crime No.1410 of 2023, registered for the offences under Sections 294(b), 506(i), 354D(1)(i), 354C of IPC, Sections 3(1)(s), 3(1)(r), 3(1)(w)(i), 3(1)(w)(ii) and 3(2)(va) of SC/ST (PoA) Act, 1989, Section 4 of TN Prohibition of Harassment of Women Act, 2002 and Section 66 E of the Information Technology (Amendment) Act, 2008. The petitioner had filed an application seeking return of property before the Principal District and Sessions Court, Tiruvallur. However, the learned trial Judge, returned the petition stating that the properties had not been received from the Forensic Science Laboratory. Aggrieved by the same, the present petition has been filed. 2/5

Learned Government Advocate (Criminal Side) appearing for the respondent submitted that since the properties sought by the petitioner are presently in the Forensic Science Laboratory and the forensic report is awaited, the trial Court had returned the application. He further submitted that the forensic report is now ready and the properties, along with the report, will be sent back to the Court concerned within a period of two weeks.

Recording the submission made by the learned Government Advocate (Criminal Side), this Criminal Original Petition stands disposed of with a direction to the respondent to obtain the forensic lab report and the properties and deposit the same before the Court concerned. On such deposit, the learned trial Judge is directed to number the petition filed by the petitioner in C.M.P.(SR) No.6254 of 2024 in S.C.No.44 of 2024 and pass orders on its own merits and in accordance with law. 12.12.2025 ham Note : Registry is directed to return the original papers to the counsel for the petitioner 3/5
